Before using our Services, please read this Policy carefully to understand how we process your personal data. By clicking "Agree" or continuing to use the Services, you represent that you have read, understood, and agreed to all the terms of this Policy.
Article 1 Definitions
- Personal Data: Refer to any data that can directly or indirectly identify a specific individual.
- Sensitive Personal Data: Refer to personal data that, if leaked, unlawfully provided, or abused, may compromise personal or property safety, or easily cause damage to personal reputation, physical and mental health, or result in discriminatory treatment. In this Policy, this primarily includes account credentials (username, password), contact information, and transaction records.
- User Uploaded Content: Refer to image files, text, materials, and any information contained therein that you voluntarily upload to our servers in order to use the Services.
Article 2 How We Collect and Use Your Personal Data
We will only collect and use your personal data for the purposes described in this Policy:
2.1 Assisting You in Registering and Managing Your Account To set up an account, you need to provide your email address, phone number, or authorize registration and login through a third-party account (such as Google, etc.). We will verify your identity by verifying your email or sending a SMS verification code to establish and protect your account. If you decline to provide this information, you will not be able to complete registration and use the full range of features, but you may still browse this Platform as a visitor.
2.2 Providing Core Translation and Image Processing Services
- (a) Information Collection: When you use features such as image translation, background removal, white background generation, or AI erasure, you need to upload image files. We will upload and temporarily store these files on our servers to perform the corresponding algorithm processing.
- (b) Data Usage and AI Model Training Authorization (Core Clause):
- The original images, materials, and translated/processed results you upload are primarily used to provide you with the corresponding task-specific services.
- System Optimization and AI Training: To continuously optimize our systems and train our AI models, unless you choose to opt out of this authorization, you hereby grant us the right to use, process, and modify your input content within the necessary scope. We commit to de-identifying or anonymizing the data during any such processes used for system optimization or model training to protect your privacy.
- Opt-out Mechanism: If you do not wish your uploaded content to be used for AI model training, you can opt out at any time through your account settings or by contacting our customer service email (pictech.ai@gmail.com). For specific enterprise-level subscriptions (such as the Business tier), we will by default not use any uploaded materials for model training.
- Except for the aforementioned purposes of providing services and system optimization/AI training (for which an opt-out mechanism is provided), we will never display, provide, or sell your uploaded content and translation results to any unrelated third party in any form.
2.3 Providing Paid Services When you purchase our paid subscription plans (such as Starter, Pro, Business, etc.), we collect your order information, transaction amount, and payment status. This information is used to process transactions, confirm your paid eligibility, and provide customer support. We do not directly collect or store sensitive financial payment information such as your full credit card number; such information is securely processed by third-party payment processors.
2.4 Service Improvement and Analytics To ensure the stability and security of the Services and to optimize our products, we may collect technical information, such as:
- Device Information: Device model, operating system version.
- Log Information: IP address, browser type, and usage data (such as feature usage, clicks, session duration). Such data is typically used in an aggregated and anonymized form for statistical analysis and service optimization.
Article 3 Use of Cookies and Similar Technologies
To ensure the proper functioning of the website and to enhance your user experience (such as remembering your login status), we use Cookies and similar tracking technologies. You can manage or delete Cookies through your browser settings. We will not use Cookies for any purposes other than those described in this Policy.
Article 4 How We Share, Transfer, and Disclose Your Personal Data
We will not share your personal data with third parties except under the limited circumstances described below.
4.1 Sharing
- With Your Explicit Consent: With your explicit consent, we may share your information with third parties.
- For Legal Reasons: If we believe in good faith that sharing your information is necessary to comply with legal obligations, court orders, or mandatory requirements of government authorities.
- With Service Providers: We may commission third-party companies and individuals (such as payment processors, cloud server providers, SMS/email delivery service providers) to perform services on our behalf. Such service providers are granted access only to the personal data necessary to perform their functions and are contractually bound not to use it for any other purpose.
4.2 Transfer We will not transfer your personal data to any other entity unless we obtain your explicit consent, or in the event of a business transfer such as a merger, acquisition, bankruptcy, or asset sale. In a business transfer, we will require the new entity to continue to be bound by this Policy.
4.3 Public Disclosure We will only publicly disclose your personal data with your explicit consent or as mandatory under applicable laws.
Article 5 How We Protect and Store Your Personal Data
5.1 Data Security We have adopted industry-standard security measures to protect the personal data you provide against unauthorized access, disclosure, use, modification, or loss. These measures include, but are not limited to, the use of HTTPS for secure transmission, encrypted data storage, and strict internal access control mechanisms.
5.2 Data Retention and Deletion Rules (Aligned with the User Service Agreement)
- (a) Retention Period: Unless a longer retention period is required or permitted by law, we will only retain your personal data for the period necessary to fulfill the purposes described in this Policy.
- (b) Deletion Period for User Uploaded Content: To protect your privacy and save server resources, we strictly enforce the following deletion policy:
- Free Users: Historical records and related uploaded/generated data generated by you on the Platform will only be retained by the system for 3 calendar days (72 hours). Any data not exported within this period will be automatically and irreversibly deleted by the system permanently.
- Paid Subscription Users: During the validity period of the subscription, historical records and generated data will be retained in the system for 30 calendar days. If your paid subscription expires and is not renewed (downgraded to a free user level), the retention period will automatically be shortened to 3 days, and historical data exceeding 3 days will be automatically cleaned up by the system at any time.
- (c) Storage Location: Your personal data may be stored and processed in any country or region where we or our service providers maintain facilities. By using the Services, you consent to the transfer of information to countries outside your country of residence, where data protection rules may differ from those in your home country.
Article 6 Your Rights Regarding Personal Data
Under applicable data protection laws, you have several rights regarding your personal data, primarily including:
- Right of Access and Correction: You can log in to your account at any time to access and update your personal data (such as changing your password, linking information, etc.).
- Right to Deletion: You can delete your translation history and related uploaded content on your own. You may also contact us to request the deletion of your specific personal data.
- Right to Withdraw Consent: You can contact us at any time, or withdraw your consent for us to collect or use your personal data by opting out of AI training authorization and adjusting your browser/device settings.
- Right to Account Cancellation: You may contact our customer service to request the cancellation of your account.
Article 7 Children's Privacy
The Services are not intended for minors under the age of 18 (hereinafter referred to as "children"). We do not knowingly collect personal data from children. If you are a parent or guardian and are aware that your child has provided us with personal data, please contact us immediately.
Article 8 Amendments to the Privacy Policy
We may revise this Policy from time to time. For any material changes, we will post the new Policy on this page and, where appropriate, notify you through more prominent means such as in-platform announcements, pop-up notifications, or emails. The revised terms shall take effect upon publication.
