Introduction & Acceptance

Welcome to PicTech AI! These Terms of Service ("Terms") constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you" or "User"), and PicTech AI ("Company," "we," "us," or "our"), concerning your access to and use of the PicTech AI website as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the "Service").

PLEASE READ THESE TERMS CAREFULLY. BY ACCESSING OR USING THE SERVICE, CLICKING "I AGREE", OR OTHERWISE INDICATING YOUR ASSENT, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SERVICE AND YOU MUST DISCONTINUE USE IMMEDIATELY.

1. Description of Service

1.1 Service Model: The Service operates on a "freemium" model, offering both free basic features and paid premium features. Users may use the single image translation feature for free or purchase Credits to access advanced services such as batch translation. The Service is fundamentally provided as an auxiliary tool for efficient text extraction and translation from images.

1.2 Scope of Features:

  • (a) Free Services:
    • Single Image Translation: Users can translate single images online without charge.
    • Online Editing: For both free and paid translations, users can edit and adjust the AI-generated text, styles, and other elements on the results page.
  • (b) Paid Services (Credit-Based):
    • Batch Translation: This feature is designed for users who need to process multiple images simultaneously, significantly improving efficiency. Using this feature will consume Credits from your account.

1.3 Service Modification: We reserve the right, in our sole discretion, to modify, suspend, or discontinue the Service, or any part thereof, including the scope of free and paid features or the pricing of Credits, at any time with or without notice to you. Any significant changes will be announced on the Platform at least seven (7) days prior to their implementation.

2. Credits: Purchase, Use, and Expiration

2.1 Credit Packages: Certain premium features (e.g., batch translation) are billed and consumed using "Credits." We offer various Credit packages, the details of which are available on the purchase page. The primary packages are:

  • Package 1: 300 Credits, valid for 30 calendar days from the date of successful purchase.
  • Package 2: 1200 Credits, valid for 60 calendar days from the date of successful purchase.

2.2 Expiration Policy:

  • (a) YOU ACKNOWLEDGE AND AGREE THAT ALL PURCHASED CREDITS HAVE A STRICT EXPIRATION DATE. The validity period begins from the moment Credits are successfully added to your account.
  • (b) UPON EXPIRATION, ANY UNUSED CREDITS FROM THE CORRESPONDING BATCH WILL BE AUTOMATICALLY AND PERMANENTLY FORFEITED. NO REFUNDS, EXTENSIONS, OR COMPENSATION OF ANY KIND WILL BE PROVIDED FOR EXPIRED CREDITS.
  • (c) We may, as a courtesy, send a reminder notification via system message seven (7) days before your Credits expire. However, it is your sole responsibility to track and use your Credits before they expire.

3. Fees and Payment

3.1 Payment Policy: Credits are considered a virtual good for use solely within the Service and are not real-world currency. You acknowledge and agree to the following:

  • (a) ALL SALES ARE FINAL AND NON-REFUNDABLE. The Service operates on a prepaid basis. Once a payment for Credits is successfully processed, it is considered final. Except as required by mandatory applicable law, WE DO NOT PROVIDE REFUNDS, EXCHANGES, OR CASH-OUTS for any fees paid for Credits under any circumstances.
  • (b) Credits have no cash value and are strictly for use within the Service to access designated premium features. Credits are non-transferable, non-assignable, non-giftable, and cannot be inherited or used for any purpose outside of the Service.
  • (c) We are not responsible for and will not protect any Credits obtained through unofficial channels (e.g., private transactions, third-party resellers). You bear all risks and losses associated with such acquisitions.

3.2 Price Adjustments: We reserve the right to adjust the pricing for Credit packages at our sole discretion. New prices will become effective from the date they are posted on the Service. Your continued purchase or use of paid features after a price change constitutes your acceptance of the new pricing.

4. Disclaimers, Limitation of Liability, and User Conduct

4.1 DISCLAIMER REGARDING TRANSLATION ACCURACY (CORE TERM)

  • (a) THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." WE PROVIDE THE SERVICE AS AN "AI TRANSLATION TOOL" TO ENHANCE EFFICIENCY. HOWEVER, DUE TO THE INHERENT LIMITATIONS OF CURRENT ARTIFICIAL INTELLIGENCE TECHNOLOGY, WE MAKE NO WARRANTIES OR REPRESENTATIONS, EXPRESS OR IMPLIED, ABOUT THE ACCURACY, COMPLETENESS, RELIABILITY, TIMELINESS, OR SUITABILITY OF THE TRANSLATION RESULTS.
  • (b) YOU ARE SOLELY AND ULTIMATELY RESPONSIBLE FOR THE FINAL REVIEW, EDITING, AND VERIFICATION OF ALL TRANSLATION RESULTS. WE DISCLAIM ALL LIABILITY FOR ANY MISUNDERSTANDINGS, ERRORS, LOSSES, OR DAMAGES OF ANY KIND ARISING FROM YOUR RELIANCE ON THE AI-GENERATED TRANSLATIONS.

4.2 DISCLAIMER REGARDING USE OF OUTPUT (CORE TERM)

  • (a) YOU ARE SOLELY RESPONSIBLE FOR THE MANNER IN WHICH YOU USE, PUBLISH, AND DISTRIBUTE ANY IMAGES PROCESSED THROUGH THE SERVICE. YOU ASSUME ALL LEGAL AND COMMERCIAL RISKS ASSOCIATED WITH YOUR USE OF THE OUTPUT.
  • (b) IN NO EVENT SHALL THE COMPANY BE LIABLE FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, INCIDENTAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, LOST PROFITS, BUSINESS INTERRUPTION, INACCURATE ACADEMIC CITATIONS, INFRINGEMENT OF THIRD-PARTY RIGHTS, LEGAL DISPUTES, OR DAMAGE TO REPUTATION OR PROPERTY, ARISING FROM OR IN CONNECTION WITH YOUR USE OF THE TRANSLATED IMAGES.

4.3 Acceptable Use Policy: You agree not to use the Service or its output for any unlawful or prohibited purpose, including but not limited to:

  • (a) Translating, creating, or distributing content that violates any applicable local, state, national, or international law or regulation, or that is obscene, defamatory, pornographic, violent, politically sensitive, or infringes upon the intellectual property, privacy, or other rights of any third party.
  • (b) Interfering with the proper functioning of the Service through technical means such as crawlers, scrapers, or malicious attacks.
  • (c) Reselling, leasing, lending, or sharing your account or the Service with any third party.

4.4 Account Security: You are responsible for maintaining the confidentiality of your account credentials. You agree to accept responsibility for all activities that occur under your account.

5. Service Interruption and Force Majeure

We shall not be liable for any failure to perform our obligations hereunder where such failure results from any cause beyond our reasonable control, including, without limitation, mechanical, electronic, or communications failure or degradation, acts of God, war, government action, or hacker attacks. We may also interrupt the service for necessary maintenance or system upgrades.

6. Intellectual Property and Privacy

6.1 Your Content: You retain all ownership rights to the original images you upload to the Service. You grant us a non-exclusive, worldwide, royalty-free license necessary to provide the translation service to you. All intellectual property related to the Service itself (logos, UI design, software code, etc.) is the exclusive property of the Company. 6.2 Privacy: We respect your privacy. Our collection and use of your personal information are governed by our Privacy Policy. We are committed to not selling your user data to any third party.

7. Governing Law and Dispute Resolution

7.1 Governing Law: These Terms and your use of the Service shall be governed by and construed in accordance with the laws of Singapore, without regard to its conflict of law principles. 7.2 Dispute Resolution: Any dispute, controversy, or claim arising out of or relating to these Terms, or the breach, termination, or invalidity thereof, shall be resolved by arbitration in accordance with the Arbitration Rules of the Singapore International Arbitration Centre (SIAC) for the time being in force, which rules are deemed to be incorporated by reference in this clause. The seat of the arbitration shall be Singapore. The language of the arbitration shall be English.

8. Miscellaneous

8.1 Amendments: We reserve the right to modify these Terms at any time. We will post the revised Terms on the Service, and they will become effective upon posting. Your continued use of the Service after the effective date of a revised version of these Terms constitutes your acceptance of its terms. 8.2 Termination: We may, in our sole discretion, suspend or terminate your account and access to the Service immediately and without prior notice if you breach any of the provisions of these Terms, particularly those outlined in Section 4.3. Upon termination, any remaining Credits in your account will be forfeited without a refund. 8.3 Severability: If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
